Committee Description

The principal responsibilities of the Legal Committee are to advise the Executive Committee and the Association's Legal Counsel on legal matters which they believe are deserving of the expenditure of Association time, effort, and funding.

Requests for the Association to enter into legal actions are referred to the Legal Committee to ascertain whether the proposal has national significance. This committee makes recommendations to the Association's Executive Committee on the significance and implications of a proposed action. In so doing the committee will continue to evaluate proposals according to the established guidelines.

Guidelines for Association Involvement in Legal Matters

The Association's legal involvement will pertain to actions which may be categorized as standard or emergency. The guidelines will apply to either type of action with procedural differences set forth for initiation of emergency action. The criterion for Association legal involvement is determination of "national significance" as opposed to regional or local. Emergency Procedure

In an emergency situation involving the necessity of an immediate reply to a request for Association action, either the President, the Executive Vice President, or the Legal Counsel may be contacted. Following immediate consultation, the Association will determine if there is need to brief the Executive Committee Chairman. Should the need arise, the Executive Committee Chairman may initiate emergency action if time does not permit polling the Legal Committee and remaining Executive Committee members. Upon initiation of emergency action, the standard procedure will then be implemented to determine the extent of Association involvement.
